These Terms of Use (“Terms”) govern your access to this website, your ticket purchase, and your participation in any event organized under the Awaken Health brand, including “Release & Rise” and future events (each, an “Event”). By purchasing a ticket or registering for an Event, you agree to these Terms.

1. About Us

This website and ticket sales are operated by Black Swan Scale Inc., a company incorporated in the United States (“Operator,” “we,” “us”). Events are organized and delivered by Awaken FZE, registered in the Ras Al Khaimah Economic Zone (RAKEZ), United Arab Emirates (“Organizer”). References to “we,” “us,” or “our” in this document apply to whichever entity is responsible for the relevant activity, as clarified where necessary.

2. Eligibility

You must be at least 18 years old to purchase a ticket or attend an Event.

3. The Event

• Dates: Saturday 7 and Sunday 8 November 2026.
• Venue: Dubai, UAE; the exact venue is confirmed by email before the event. Confirmed details are emailed to all registered participants.
• Language: English throughout.
• Group size: limited to 30 participants.
• Catering: all food provided at the Event is fully plant-based.
• Your ticket covers attendance for both days, workshop materials and refreshments. Travel, accommodation and visas are your own responsibility unless you booked an accommodation package.

4. Ticket Purchase & Payment

• All ticket prices are listed in US Dollars and must be paid in full at the time of booking, unless otherwise stated. Your place is not held until payment clears.
• Ticket sales, payment processing, and the website are operated by Black Swan Scale Inc. Black Swan Scale Inc. sells tickets directly and is not required to be registered as an official or government-approved ticket-selling platform for this purpose.
• Payment is processed through a secure, encrypted third-party payment gateway. We do not see or store your full payment card details. Your payment will appear on your card statement as Black Swan Scale Inc.
• Your ticket confirms a reserved place at the specified Event only; it is non-transferable unless we agree otherwise in writing.
• Early Bird pricing applies to bookings made before 25 October 2026, 23:59 Gulf Standard Time.
• Any bank charges, currency conversion fees or local taxes are your responsibility.

5. Our Day One Guarantee

If you attend an Event and, by the end of Day 1, you do not feel it was worth what you paid, tell the facilitator before Day 2 begins and Black Swan Scale Inc. will refund your ticket price in full. No forms and no questions asked. We would simply appreciate five minutes of honest feedback first, though the refund does not depend on it.

This guarantee covers the ticket price only. It does not cover travel, accommodation, or any VIP dinner or meal already taken.

6. Cancellations & Refunds

This section covers cancelling before an Event, and is separate from the Day One Guarantee in Section 5.

• More than 14 days before the Event: full refund, less any payment-processing fee charged by the payment gateway.
• 7 to 14 days before: 50% refund, or transfer your full payment to a future Event, subject to availability.
• Less than 7 days before: no refund. Your place may be passed to another person only where we agree in writing, on at least 48 hours’ notice.
• Online Access tickets: work differently, because there is no venue cost involved. You may request a full refund within 14 days of receiving the recording. The Day One Guarantee in Section 5 applies to Online Access in the same way as to in-person tickets.
• To cancel, email office@releaseandrise.events. The date your email reaches us is the date that counts.

If the Event is cancelled or postponed for any reason, you will be offered a full refund or the option to transfer to a rescheduled date.

7. Changes to an Event

Awaken FZE, as Organizer, reserves the right to change the venue, facilitator, schedule, or format of an Event due to circumstances beyond its reasonable control (including but not limited to venue availability or government permit requirements). Registered participants will be notified of any material change as soon as reasonably possible. A change of venue within the same emirate is not grounds for a refund.

8. Health, Safety & Assumption of Risk

Our Events include breathwork, guided movement (including Qi Gong), and emotional release exercises delivered by Awaken FZE as Organizer. By registering, you acknowledge that:

• Our Events are not a substitute for medical or psychological treatment. If you have a pre-existing physical or mental health condition, we strongly recommend you consult a qualified healthcare professional before attending.
• You are voluntarily participating and are responsible for assessing your own physical and emotional readiness to take part.
• You should inform the facilitator before the Event begins of any condition that may affect your participation (e.g., pregnancy, heart conditions, respiratory conditions, or recent trauma) so that reasonable accommodations can be considered.
• Participation in breathwork or physical exercises is at your own risk. You may opt out of any specific exercise at any time.
• To the fullest extent permitted by law, neither Awaken FZE nor Black Swan Scale Inc. is liable for any physical or emotional distress arising from voluntary participation in Event activities, except where caused by gross negligence or willful misconduct.

9. Code of Conduct

We ask all participants to engage respectfully with facilitators and fellow attendees, and to maintain the confidentiality of anything shared by other participants during the Event. Awaken FZE, as Organizer, reserves the right to remove any participant whose conduct is disruptive, unsafe, or disrespectful, without refund, including anyone under the influence of alcohol or drugs during sessions.

10. Photography & Recording

Photography or video may be taken during an Event for archival or promotional purposes by Awaken FZE or its representatives. If you do not wish to appear in promotional material, please notify us before the Event begins, and we will make reasonable efforts to accommodate your request.

Participants may not record, photograph or film other participants at any time.

11. Intellectual Property

All workshop materials, exercises, and content are the intellectual property of Awaken FZE and Paul Nazaruk. The website design and platform are the property of Black Swan Scale Inc. You may not record, reproduce, or redistribute Event content for commercial purposes without written consent.

12. Limitation of Liability

To the fullest extent permitted by applicable law, the total combined liability of Awaken FZE and Black Swan Scale Inc. to you in connection with an Event or the website is limited to the amount you paid for your ticket, except in cases of gross negligence, willful misconduct, or where liability cannot be excluded by law.

13. Force Majeure

Neither party is liable for failure to perform its obligations where this is due to circumstances beyond its reasonable control, including government action, natural disaster, or public health emergency.

14. Governing Law & Jurisdiction

14.1 Website, Ticketing & Payment

These Terms, to the extent they relate to your access to and use of the website, and to the purchase, payment, and delivery of tickets, constitute an agreement between you and Black Swan Scale Inc. and are governed by and construed in accordance with the laws of ⟦ASK PAUL: state of incorporation⟧, United States, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to the website or your ticket purchase shall be subject to the exclusive jurisdiction of the state and federal courts located in that state, and you consent to the personal jurisdiction of such courts for this purpose.

14.2 Event Participation

These Terms, to the extent they relate to your attendance at and participation in an Event (including without limitation the health, safety, conduct, and liability provisions in Sections 8 and 9) constitute an agreement between you and Awaken FZE and are governed by and construed in accordance with the laws of the United Arab Emirates as applied in the Emirate of Dubai / Ras Al Khaimah. Any dispute arising out of or relating to your participation in an Event shall be subject to the exclusive jurisdiction of the onshore courts of Dubai.

14.3 Separate & Independent Obligations

Black Swan Scale Inc. and Awaken FZE are separate legal entities. Each is independently responsible only for the obligations it undertakes under these Terms as described above, and nothing in this Section 14 makes either entity liable for the obligations or conduct of the other. Where a dispute touches on both the website/ticketing relationship and the Event-participation relationship, the parties agree to first attempt in good faith to identify which entity’s obligations are actually at issue, and to resolve the matter through good-faith negotiation before pursuing formal proceedings.

14.4 Consumer Protection

Nothing in this Section 14 is intended to limit any mandatory consumer protection rights you may have under the law of your place of residence, to the extent such rights cannot lawfully be excluded or limited by agreement.

15. Changes to These Terms

We may update these Terms from time to time. Continued use of the website or participation in a future Event after changes are posted constitutes acceptance of the revised Terms.
